These Terms of Service ("Terms") govern your access to and use of the services, website, online course, book, and mediation services (collectively, the "Services") provided by TogetherApart.life ("we," "us," or "our").
By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Services.
2. Services Description
2.1 Mediation Services
We provide family mediation services focused on co-parenting after separation. Our mediation services are intended to facilitate communication and agreement between separated parents.
2.2 Online Course
Our "Transform Your Co-Parenting" online course provides educational content, tools, and resources for improving co-parenting relationships.
2.3 Book
"Exes, Not Enemies" is a guidebook offering strategies and advice for peaceful co-parenting.
2.4 Website
Our website provides information about our services, resources, and allows for booking and purchasing our offerings.
3. User Accounts
3.1 Account Creation
Some of our Services require you to create an account. You must provide accurate, current, and complete information during the registration process.
3.2 Account Responsibilities
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
4. Payment Terms
4.1 Fees
Fees for our Services are posted on our website and may be subject to change. All fees are in New Zealand Dollars unless otherwise specified.
4.2 Payment
Payment for our Services must be made in advance. We accept payment via the methods specified on our website.
4.3 Refunds
•Mediation Services: Cancellations made more than 48 hours before a scheduled session may receive a full refund. Cancellations made less than 48 hours before a scheduled session may be subject to a cancellation fee.
•Online Course: You may request a refund within 14 days of purchase if you have completed less than 25% of the course content.
•Book: Digital book purchases are non-refundable once downloaded. Physical book returns must comply with our return policy posted on our website.
5. Intellectual Property Rights
5.1 Our Content
All content included in our Services, such as text, graphics, logos, images, videos, and software, is owned by TogetherApart.life or our licensors and is protected by copyright, trademark, and other intellectual property laws.
5.2 Limited License
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for your personal, non-commercial use.
5.3 Restrictions
You may not:
•Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or content obtained from our Services

Information shared during mediation sessions is confidential, subject to legal requirements and exceptions outlined in our Mediation Agreement.
7.2 Course Participation
Information shared in course forums or community spaces is not confidential. We encourage users to exercise discretion when sharing personal information.

8.1 No Professional Advice
Our Services provide information and tools for educational purposes only and do not constitute legal, psychological, or other professional advice. You should consult with appropriate professionals for specific advice.
8.2 No Guarantee of Outcomes
We do not guarantee specific outcomes from using our Services. Results may vary based on individual circumstances, effort, and other factors.
8.3 "As Is" Basis
Our Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
9. Limitation of Liability
To the maximum extent permitted by law, TogetherApart.life shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
•Your use or inability to use our Services
•Any unauthorized access to or use of our servers and/or any personal information stored therein
•Any interruption or cessation of transmission to or from our Services
•Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services

You agree to defend, indemnify, and hold harmless TogetherApart.life, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

Any dispute arising from or relating to these Terms or our Services shall first be attempted to be resolved through mediation. If mediation is unsuccessful, the dispute shall be resolved through arbitration in accordance with the Arbitration Act 1996 of New Zealand.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
16. Entire Agreement
These Terms constitute the entire agreement between you and TogetherApart.life regarding our Services and supersede all prior agreements and understandings.
